Consumer Rights, Withdrawal, Cancellation and Return Conditions

General

1. By placing an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales agreement presented to you.

2. Buyers are subject to the provisions of the Law on Consumer Protection No. 6502, the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they have purchased.

3. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, Buyers may terminate the contract.

4. The purchased product must be delivered completely, in accordance with the specifications stated in the order, and with warranty certificates, user manuals, if any.

5. If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days from the date of learning about this situation. The total amount must be refunded to the Buyer within 14 days.

If the Price of the Purchased Product is Not Paid

6. If the Buyer does not pay the price of the purchased product or cancels it in the bank records, the Seller's obligation to deliver the product ends.

Purchases Made with Unauthorized Credit Card Use

7. If it is determined that the credit card used by the buyer for payment has been unlawfully used by unauthorized persons after the product has been delivered, and if the sale price of the product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days, with the shipping costs borne by the SELLER.

If the Product Cannot Be Delivered on Time Due to Unforeseen Reasons

8. If force majeure events that the Seller cannot foresee occur and the product cannot be delivered on time, the Buyer will be notified of the situation. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this fee will be refunded in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels, the product price will be refunded to the bank within 14 days from this cancellation, but it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.

Buyer's Obligation to Inspect the Product

9. The Buyer will inspect the goods/services subject to the contract before receiving them; will not receive damaged or defective goods/services such as dents, breakages, torn packaging, etc. from the cargo company. The received goods/services will be deemed undamaged and sound. THE BUYER is obliged to carefully protect the goods/services after delivery. If the right of withdrawal is to be used, the goods/services should not be used. The invoice must also be returned with the product.

Right of Withdrawal

10. THE BUYER; may exercise their right of withdrawal from the contract by rejecting the goods without assuming any legal or criminal liability and without showing any reason, provided that they notify the SELLER via the contact information below, within 14 (fourteen) days from the delivery date of the purchased product to them or the person/organization at the address indicated, and within 1 day from the product delivery for formal wear, stone-set, and delicate products.

Period of Right of Withdrawal

12. If the Buyer has purchased a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has begun with the consumer's consent before the right of withdrawal period expires.

13. The expenses arising from the exercise of the right of withdrawal belong to the SELLER.

14. To exercise the right of withdrawal, it is essential to give written notice to the SELLER by registered mail, fax, or email within 14 (fourteen) days, and that the product has not been used within the scope of the "Products for which the Right of Withdrawal Cannot Be Used" provisions regulated in this contract.

14.1. For product returns, you can send it to the address of Cercis Giyim via Yurtiçi Cargo with the code 123 254 6402. During the product return process, the shipping fee must be paid by the customer.

Exercise of the Right of Withdrawal

15. The invoice of the product delivered to the 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution. Order returns issued in the name of institutions cannot be completed unless a RETURN INVOICE is cut.)

16. The return form, the box, packaging, and any standard accessories of the products to be returned must be delivered completely and undamaged.

Return Conditions

17. The SELLER is obliged to return the total amount and the documents that put the BUYER under debt to the BUYER within a maximum of 10 days from the receipt of the withdrawal notification, and to take back the goods within 20 days.

19. If there is a decrease in the value of the goods due to the fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER for damages in proportion to their fault. However, the BUYER is not responsible for changes and deteriorations caused by proper use of the goods or product within the right of withdrawal period.

20. If the campaign limit amount determined by the SELLER is fallen below due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign will be canceled.

Products for Which the Right of Withdrawal Cannot Be Used

21. It is not possible to return products prepared according to the BUYER's wishes or explicit personal needs, single-use products, products that are in danger of spoiling quickly or whose expiration date is likely to pass, products whose packaging has been opened by the BUYER after delivery and which are not suitable for return for health and hygiene reasons, and products that are mixed with other products after delivery and cannot be separated due to their nature, according to the Regulation. In addition, it is not possible to exercise the right of withdrawal for services whose performance has begun with the consumer's consent before the right of withdrawal period expires, according to the Regulation.

22. For cosmetic and personal care products to be returned, their packaging must be unopened, untried, undamaged, and unused.

Default and Legal Consequences

23. If the BUYER defaults when making payments with a credit card, they accept, declare, and undertake that they will pay interest within the framework of the credit card agreement with the cardholder bank and will be responsible to the bank. In this case, the relevant bank may resort to legal remedies; may demand the resulting expenses and attorney's fees from the BUYER, and in any event, if the BUYER defaults on their debt, the BUYER agrees to pay the SELLER's loss and damage incurred due to the delayed performance of the debt.

International Shipments

Exchanges and returns are not made for international shipments. For international shipments, costs for packages returned without being received are borne by the buyer. Costs are deducted from the order total and the remaining amount is refunded.
